History Of 16th December – The Case of The Heart-Wrenching, 2012 Delhi Gang Rape

When Did The 2012 Delhi Gang Rape Happen and Why Was It the Most Horrifying and Brutal Case That India Had Ever Come Across


 

India has not always been the best in protecting their daughters and providing them with justice since forever. The Indian government has always failed to introduce adequate laws in regards to women’s safety. The rates of crime against women have continuously been rising and amongst them, sexual violence is the most horrific crime embedded in the male dominant society and its patriarchal standards. According to a report released by the National Crime Records Bureau (the NCRB) of 2019 (annual report), the number of reported cases of rape that year in the country were 32,033 which makes almost 88 cases on daily basis and it’s extremely horrific considering that thousands of cases go unnoticed each year. Amongst the several cases of crime against women the 2012 Nirbhaya case story shook the whole nation to its core and enraged women across the nation to fight for justice.

                              

This Is How All the Incidents Unfolded on The Night Of 16th December 2012:

·  23 years old Jyoti Singh (Nirbhaya) and one of her male friends boarded a bus from Munirka for Dwarka on the night of 16th December in 2012 at about 9:30 PM.

·     The bus that they boarded consisted of six people which included the bus driver himself. Suddenly, the bus changed its route and took a route that wasn’t usually used.

·     On being asked why the bus changed its route the six men started an argument with Jyoti’s friend. A fight broke out between them in which her friend was beaten brutally and later knocked out of consciousness with an iron rod.

The Heinous Act That Nirbhaya Had to Be A Victim Of

The five men dragged Jyoti (Nirbhaya) and took her to the rear of the bus while the driver kept on driving the bus. They beat Jyoti and raped her brutally. She had various abdominal and genital injuries which indicated that a sharp object had caused that damage. After beating and raping her, she and her friend were thrown out of the moving bus by their assaulters. According to the investigating police, Jyoti tried to stop the men by kicking and biting them but eventually gave up. The two victims were found struggling on the road by a passerby who then called the Delhi Police who took them to Safdarjung Hospital for them to acquire an emergency treatment. Nirbhaya was later transferred to a hospital in Singapore, 11 days after the assault. Her condition worsened as the days passed and unfortunately, she lost her life after just two days of being transferred to Singapore on the 29th of December.

Just the thought of something so horrible would send a chill across one’s spine. No one deserves to go through such an awful experience. After the heinous incident caught the eyes of the general public, the media, and other foreign countries; people were inflamed and demanded justice for Nirbhaya. Her journey towards justice wasn’t an easy one and it took many years for the government to give justice to an innocent soul who lost her life because of some disgusting demons.

Protests and A Nation-wide Call for Justice

·  After the incident happened, there were various protests held by the general public. One of the most significant protests was held on the 21st of December 2012 at both, Raisina Hill as well as India Gate in DelhiThese protests were the most chaotic protests as people were outraged and a lot of people were arrested that day.

·     Not only protests but various candle marches and silent marches were held by the public all across the country. Many people started asking for justice through social media. A large number of petitions were signed by the public that demanded the government to hang the rapists.

The NIRBHAYA ACT, 2013

An act was passed on 19th March 2013 by the Lok Sabha and then on 21st March, 2013 by the Rajya Sabha that provided an amendment in the Criminal Law Act regarding sexual violence or assault. This Bill was approved by the President on the 2nd of April, 2013 which was brought into action on 3rd February 2013 which added human trafficking, stalking attempted acid attack and sexual harassment in the list of offenses. Also, two main changes were made:

1.)  A new law of ‘no consent’ was introduced wherein if there is proof of intercourse but the victim states in the court that it was without her consent then the judgment will be passed in her favor.

2.)  The so-called ‘character’ of a victim is considered irrelevant in court.

 

A Big Milestone

20th March, 2020 was indeed the happiest day for women all across the country and the world in fact. The four convicts were executed on 20th March, 2020 in Tihar Prison Complex, Delhi at 5:30 AM under conviction of rape, assault, and murder. One of the six accused committed possible suicide on the 11th of March, 2013 and one assaulter who was a juvenile served a three years sentence of imprisonment.

Conclusion

It was very disgraceful that it took 9 long years to give justice to an innocent woman who was literally tortured and murdered. All thanks to Nirbhaya’s parents for not giving up and to the Supreme Court advocate Seema Kushwaha who was representing Nirbhaya’s parents and who did not give up either and strived very hard to acquire justice for Nirbhaya.

It is also necessary for the government of India to introduce strict laws to protect their daughters and make sure that they acquire speedy justice if they are assaulted for now it is high time for everyone to wake up and realize that women do not feel safe after hearing all the nerve-wracking incidents that take place in India and that it should stop as soon as possible as India is a country also known to worship female goddesses and it would be very shameful if it fails to protect the females of its country.
